These "Terms of Use" govern your access to the Website and use o fit. By using the Website, you agree to these Terms of Use. If you do not agree to the Terms of Use, you may not use the Website. Additional terms and conditions may apply to the purchase of goods and services from Dreame and to certain features. In the event of any conflict between these Terms of Use and such additional terms, the additional terms may prevail for the specific service area covered. Right of use and restrictions 2.1 Unless expressly permitted under these Terms of Use, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, license, or otherwise make available any part of the website or its contents on other computers, servers, websites, or other media for these purposes without the prior written consent of Dreame. You are obliged to keep your access data secret and to protect access to your account. You are liable for all activities that take place under your account, insofar as you are responsible for them. Dreame must be informed immediately of any unauthorized use. 3.2 If you are able to choose a username, it must not be illegal, offensive, misleading, or otherwise inappropriate. Impersonating others or appearing to be affiliated with Dreame is prohibited. 3.3 Dreame is entitled to block or deactivate accounts if there is a violation of these Terms of Use, if legal obligations require it, or if the legitimate interests of Dreame or third parties require so. Actions will be communicated with a justification, if required by law. 4 Terms of Use and Conduct Guidelines 4.1 The forum allows you to publish content such as comments, images, audio and video content ("user content"). You are solely responsible for your user content and warrant that you have all the rights necessary for its use and processing as provided for in these Terms of Use. If persons are recognizably depicted, you warrant that the depiction is lawful and that the necessary consents have been obtained. 4.2 By uploading or publishing user content, you provide Dreame a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, technically process, make publicly available, distribute, display, and edit user content for the purposes of operating, providing, securing, improve, and promoting the website. The license ends as soon as you delete the user content from the website. The license continues to exist to the extent that copies remain for a limited period of time as part of normal data backups or user content that has already been legally shared, quoted, or reused by other users. Personal rights and moral rights are protected. 4.3 You ensure that you have all necessary rights to the content you post and that its use within the scope of these terms and conditions does not infringe any third-party rights (in particular copyrights, trademarks, or personal rights) or legal regulations. You agree to comply with the following rules of conduct and to refrain from the actions listed below: (a) Posting user content that infringes the rights of third parties, incites legal violations, circumvents security measures, contains malicious code, disrupts the operation of the website, constitutes spam, contains false or misleading information, or gives the impression of being official statements by Dreame (b) Creating, using, sharing, and/or publishing user content in any way that would constitute an infringement of intellectual property rights or the personal rights of an individual, or that would incite the commission of an unlawful act (in particular piracy, cracking, or distribution of counterfeit software) (c) Post or transmit content that is offensive, abusive, defamatory, threatening, unlawful, misleading, false, or harmful, or otherwise violates applicable law or morality; (d) Posting personal, private, or confidential information belonging to others; (e) Planning or carrying out illegal, fraudulent, or manipulative activities; (f) Flood the forum with excessive, meaningless, or off-topic content, disrupt discussions inappropriately, (g) Posting automated content or spreading speculation and rumors about unannounced Dreame products. (h) Publish content that contains instructions that facilitate the misuse of warranties or services, circumvent security measures, or give advice that, if followed, could result in personal injury, property damage, or criminal offenses. (i) Disrupt, block, subject to excessive load, interrupt, slow down, and/or hinder the normal functioning of the software or its parts or their availability to other users, or attempt to do so. (j) Transmit or disseminate viruses, Trojan horses, worms, logic bombs, corrupted files, and/or other similarly destructive devices or altered data within the software and/or organize, participate in, or otherwise be involved in attacks on servers and/or the software and/or those of its service providers and partners; (k) Spam the chat for personal or commercial purposes by interrupting the flow of conversation with repeated postings of a similar nature; (l) Content that is deemed or considered offensive at Dreame's sole and exclusive discretion, including, but not limited to, abusive, threatening, unlawful, offensive, harassing, defamatory, libelous, obscene, sexually explicit, or racially, ethnically, or otherwise objectionable statements; (m) harass or threaten other users of the software; 4.4 Dreame is entitled, but not obligated, to review or moderate user content in advance and to monitor the relevant areas of the website. 4.5 Dreame does not guarantee the permanent availability, accuracy, or legality of user content. Statements, advice, and opinions of other users are not to be regarded as those of Dreame. User contributions may therefore also contain information about products not manufactured by Dreame and links to websites not controlled by us. Such information should not be understood as recommendations or endorsements by Dreame. Dreame also takes no responsibility for this. 4.6 Claims regarding user content must be directed to the respective user. Dreame explicitly reserves the right to take measures regarding the availability and accessibility of user content without prior notice if there are legitimate reasons for doing so, in particular if such content violates legal regulations and/or the provisions of these Terms of Use. In this regard, Dreame explicitly reserves the right to temporarily or permanently exclude users who violate the rules of conduct from accessing the forum, in particular to block or delete accounts that repeatedly violate these provisions. 5 Reporting illegal content 5.1 Dreame provides an easily accessible reporting channel for illegal content. Reports should include sufficient justification, the specific location of the content (e.g., URL or unique identifiers), the contact details of the person reporting it, and a statement of accuracy. Dreame will review reports promptly, takes appropriate action, and communicates justified decisions. 5.2 Dreame may take action against user content or accounts if the content violates the law or these Terms of Use, or if Dreame is required to do so by law. Actions may include removal, blocking, restriction of visibility, de-indexing, age restrictions, or account sanctions. Dreame will inform affected users of the reasons for such decisions, to the extent required by law, and, where applicable, provide information about legal remedies. If Dreame takes action against a user or their content, the affected user will receive a clear explanation stating the underlying facts, the legal or contractual basis, any automated means, the duration, the territorial scope, and the available legal remedies. 5.3 Dreame maintains an internal complaint procedure that allows users to dispute decisions regarding moderation or account actions. Complaints will be reviewed within a reasonable time frame, in a non-discriminatory, careful, and non-arbitrary manner. A reasoned decision will be provided. If a complaint is deemed justified, the decision will be reversed or adjusted. Notwithstanding this, users may, where applicable, refer the matter to out-of-court dispute resolution bodies. 5.4 Dreame uses both automated systems and manual reviews for moderation and fraud prevention. The use of such systems is in accordance with applicable law. Details on how they work are made transparent in an appropriate manner, as far as this is possible without compromising their effectiveness and security. 5.5 Dreame sets up central contact points for user inquiries and for inquiries from authorities. The current contact details are available on the website. Since Dreame is not based in the EU, a legal representative based in the EU has been appointed. Their contact details are published on the website. 5.6Dreame reserves the right to disclose any information we have about you (including your identity) if it is determined that such disclosure is necessary in connection with an investigation or complaint regarding your use of the website, or to identify, contact, or bring legal action against someone who may be violating or interfering with Dreame's rights or property, or the rights or property of other users of the website. Dreame explicitly reserves the right to disclose any information that is considered as necessary to comply with any applicable laws, regulations, legal processes, or governmental requests at any time. If national law requires the consent of a parent or legal guardian, you ensure that such consent has been obtained and can be provided upon request. Regardless of this, the use of interactive features without parental consent is only permitted from the age of 16, unless the law applicable in your Member State provides for a lower age limit, which may not be less than 13 years. 7 Intellectual property and property rights 7.1 All ownership and proprietary rights and all intellectual property rights relating to the website and its content (including, but not limited to, all text, graphics, music or sounds, all communications or information, domain names and all other elements belonging to the website, individually or in combination) and all copies thereof are the property of Dreame and/or its licensors. This includes reasonable costs of legal defense. The indemnification does not apply if you are acting as a consumer and such an obligation would be inadmissible under mandatory law. 10.9 We reserve the right to offer content created using artificial intelligence (AI) as part of the Services. This AI-generated content may include text, images, videos, music, and other media formats. Dreame assumes no liability for the accuracy, completeness, or suitability of this content. 11 Termination, suspension, and consequences of termination 11.1 You may discontinue use of the website at any time and delete your account, as long as an account deletion function is available or can be accessed via support. 11.2 Dreame may terminate or restrict access to the website or your account if you violate these Terms of Use, if required by law, or if the legitimate interests of Dreame or third parties so require. To the extent required by law, Dreame may provide justification and may open an internal complaint procedure. 11.3 Upon termination, your right of access may expire.
