Terms of Use for the DREAME Forum

Dreame International (Hong Kong) Limited, Room H28G, Blk EH, 10th Floor, Golden Bear Ind.Ctr., 66-82 Chai Wan Kok St., Tsuen Wa, Hong Kong ("Dreame"), operates the website at forum.dreametech.com, including a discussion forum which is available for customers and interested parties (collectively, the "Website" or "Forum", "Services"). These "Terms of Use" govern your access to  the Website and use o fit. By using the Website, you agree to these Terms of Use. If you do not agree to the Terms of Use, you may not use the Website. Additional terms and conditions may apply to the purchase of goods and services from Dreame and to certain features. In the event of any conflict between these Terms of Use and such additional terms, the additional terms may prevail for the specific service area covered.

We may update these Terms of Use from time to time. You mustagree to these changes. If you do not agree to future changes, you should consider not using the website.

1 General

1.1 Dreame grants you a simple, revocable, non-transferable, and non-sublicensable right to use the website in accordance with these Terms of Use. All rights to the website and its content remain with Dreame and/or its licensors. The website and all its content contained therein, including graphics, text, user interfaces, photographs, trademarks, logos, sounds, music, illustrations, designs, source and object codes, layout, and "look and feel" ("content"), are protected by law. The granting of the right to use and the provision of the website does not constitute a sale or transfer of rights.

1.2 Registration may be required to use all features of the website. You are responsible for complying with these Terms of Use and for all activities that occur under your account. You ensure that all information you provide is accurate, current, and complete, and that you will update changes immediately while you are using the website.

1.3 As far as Dreame processes personal data, this is done in accordance with the applicable data protection laws, in particular with the GDPR. Further information can be found in Dreame's privacy policy, available at https://forum.dreametech.com/portal.php?mod=view&aid=3. For cookies and similar technologies, additional information applies in the cookie notices provided there.

1.4 These Terms of Use apply exclusively to the use of the website. The purchase of goods or the use of services from Dreame is subject to separate terms and conditions. In the event of conflicts in connection with such services, the relevant terms and conditions may take precedence.

1.5 Any use beyond the scope of these Terms of Use is prohibited.

2. Right of use and restrictions

2.1 Unless expressly permitted under these Terms of Use, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, license, or otherwise make available any part of the website or its contents on other computers, servers, websites, or other media for these purposes without the prior written consent of Dreame. You may not remove or edit any applicable proprietary notices. The information provided on the website may only be used for personal, non-commercial use and in accordance with the Terms of Use.

2.2 Commercial use of the website or its content is generally  prohibited and only permitted with the separate written consent of Dreame on the basis of a separate license. This applies in particular to resale, rental, leasing, offering paid access, reading content for a fee, or similar forms of exploitation.

2.3 You may not, directly or indirectly, (i) sell, rent, lease, license, distribute, market, or otherwise commercially exploit the website and/or its content or any part thereof, (ii) reverse engineer, decompile, disassemble, adapt, reproduce, or create derivative works based on the software, in whole or in part (except where the software enables the user to create, generate, or send user-generated content through a special function, for which the user must open an account and comply with the terms of use); (iii) crawl or scrape, whether manually or automatically, or use any other automated means (in particular bots, scrapers, and spiders) to view, retrieve, or collect information, as well as the use of any part of the Services and Content to train machine learning or AI models or otherwise feed such content into a machine learning or AI model; (iv) circumventing technologies used by us, including territorial or other content access restrictions; (v) removing, altering, disabling, or circumventing copyright and trademark notices or other copyright and origin information, proprietary notices, or labels present on or in the content of the website; and (vi) executing or re-exporting the website or any content thereof, or any copy or adaptation thereof, in violation of applicable laws or regulations.

2.4 It is prohibited to gain or attempt to gain unauthorized access to any part of the website, systems, networks, or services connected to the website. It is also prohibited to check, scan, or test the security of the website, violate authentication measures, intercept user information, or track other users. It is also prohibited to distribute malware, viruses, worms, Trojan horses, time bombs, corrupted files, or similar harmful content, to disrupt the proper operation of the website, or to deliberately overload its systems.

2.5 You may not publish or transmit any content that is unlawful, misleading, offensive, defamatory, libelous, harassing, abusive, obscene, discriminatory, or otherwise inappropriate, infringes on the rights of third parties, or incites third parties to commit unlawful acts. This includescontent that infringes intellectual property rights, personal rights, data protection rights, trade secrets, or other rights of third parties, as well as unsolicited advertising, spam and chain letters. You may not publish ´nor transmit other people’s personal data without legal basis nor misrepresent them through fraudulent or manipulative depictions.

3 Registration

3.1 Registration for a user account may be required for certain functions. You are obliged to keep your access data secret and to protect access to your account. You are liable for all activities that take place under your account, insofar as you are responsible for them. Dreame must be informed immediately of any unauthorized use.

3.2 If you are able to choose a username, it must not be illegal, offensive, misleading, or otherwise inappropriate. Impersonating others or appearing to be affiliated with Dreame is prohibited.

3.3 Dreame is entitled to block or deactivate accounts if there is a violation of these Terms of Use, if legal obligations require it, or if the legitimate interests of Dreame or third parties require so. Actions will be communicated with a justification, if required by law.

4 Terms of Use and Conduct Guidelines

4.1 The forum allows you to publish content such as comments, images, audio and video content ("user content"). You are solely responsible for your user content and warrant that you have all the rights necessary for its use and processing as provided for in these Terms of Use. If persons are recognizably depicted, you warrant that the depiction is lawful and that the necessary consents have been obtained.

4.2 By uploading or publishing user content, you provide Dreame a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, technically process, make publicly available, distribute, display, and edit user content for the purposes of operating, providing, securing, improve, and promoting the website. The license ends as soon as you delete the user content from the website. The license continues to exist to the extent that copies remain for a limited period of time as part of normal data backups or user content that has already been legally shared, quoted, or reused by other users. Personal rights and moral rights are protected.

4.3 You ensure that you have all necessary rights to the content you post and that its use within the scope of these terms and conditions does not infringe any third-party rights (in particular copyrights, trademarks, or personal rights) or legal regulations. Furthermore, you ensure that your content does not give the impression of affiliation with or endorsement by Dreame, unless explicit consent has been given. You agree to comply with the following rules of conduct and to refrain from the actions listed below:

(a) Posting user content that infringes the rights of third parties, incites legal violations, circumvents security measures, contains malicious code, disrupts the operation of the website, constitutes spam, contains false or misleading information, or gives the impression of being official statements by Dreame

(b) Creating, using, sharing, and/or publishing user content in any way that would constitute an infringement of intellectual property rights or the personal rights of an individual, or that would incite the commission of an unlawful act (in particular piracy, cracking, or distribution of counterfeit software)

(c) Post or transmit content that is offensive, abusive, defamatory, threatening, unlawful, misleading, false, or harmful, or otherwise violates applicable law or morality;

(d) Posting personal, private, or confidential information belonging to others;

(e) Planning or carrying out illegal, fraudulent, or manipulative activities;

(f) Flood the forum with excessive, meaningless, or off-topic content, disrupt discussions inappropriately,

(g) Posting automated content or spreading speculation and rumors about unannounced Dreame products.

(h) Publish content that contains instructions that facilitate the misuse of warranties or services, circumvent security measures, or give advice that, if followed, could result in personal injury, property damage, or criminal offenses.

(i) Disrupt, block, subject to excessive load, interrupt, slow down, and/or hinder the normal functioning of the software or its parts or their availability to other users, or attempt to do so.

(j) Transmit or disseminate viruses, Trojan horses, worms, logic bombs, corrupted files, and/or other similarly destructive devices or altered data within the software and/or organize, participate in, or otherwise be involved in attacks on servers and/or the software and/or those of its service providers and partners;

(k) Spam the chat for personal or commercial purposes by interrupting the flow of conversation with repeated postings of a similar nature;

(l) Content that is deemed or considered offensive at Dreame's sole and exclusive discretion, including, but not limited to, abusive, threatening, unlawful, offensive, harassing, defamatory, libelous, obscene, sexually explicit, or racially, ethnically, or otherwise objectionable statements;

(m) harass or threaten other users of the software;

4.4 Dreame is entitled, but not obligated, to review or moderate user content in advance and to monitor the relevant areas of the website.

4.5 Dreame does not guarantee the permanent availability, accuracy, or legality of user content. Statements, advice, and opinions of other users are not to be regarded as those of Dreame. User contributions may therefore also contain information about products not manufactured by Dreame and links to websites not controlled by us. Such information should not be understood as recommendations or endorsements by Dreame. Dreame also takes no responsibility for this.

4.6 Claims regarding user content must be directed to the respective user. Dreame explicitly reserves the right to take measures regarding the availability and accessibility of user content without prior notice if there are legitimate reasons for doing so, in particular if such content violates legal regulations and/or the provisions of these Terms of Use. In this regard, Dreame explicitly reserves the right to temporarily or permanently exclude users who violate the rules of conduct from accessing the forum, in particular to block or delete accounts that repeatedly violate these provisions.

5 Reporting illegal content

5.1 Dreame provides an easily accessible reporting channel for illegal content. Reports should include sufficient justification, the specific location of the content (e.g., URL or unique identifiers), the contact details of the person reporting it, and a statement of accuracy. Dreame will review reports promptly, takes appropriate action, and communicates justified decisions.

5.2 Dreame may take action against user content or accounts if the content violates the law or these Terms of Use, or if Dreame is required to do so by law. Actions may include removal, blocking, restriction of visibility, de-indexing, age restrictions, or account sanctions. Dreame will inform affected users of the reasons for such decisions, to the extent required by law, and, where applicable, provide information about legal remedies. If Dreame takes action against a user or their content, the affected user will receive a clear explanation stating the underlying facts, the legal or contractual basis, any automated means, the duration, the territorial scope, and the available legal remedies.

5.3 Dreame maintains an internal complaint procedure that allows users to dispute decisions regarding moderation or account actions. Complaints will be reviewed within a reasonable time frame, in a non-discriminatory, careful, and non-arbitrary manner. A reasoned decision will be provided. If a complaint is deemed justified, the decision will be reversed or adjusted.  Notwithstanding this, users may, where applicable, refer the matter to out-of-court dispute resolution bodies.

5.4 Dreame uses both automated systems and manual reviews for moderation and fraud prevention. The use of such systems is in accordance with applicable law. Details on how they work are made transparent in an appropriate manner, as far as this is possible without compromising their effectiveness and security.

5.5 Dreame sets up central contact points for user inquiries and for inquiries from authorities. The current contact details are available on the website. Since Dreame is not based in the EU, a legal representative based in the EU has been appointed. Their contact details are published on the website.

5.6Dreame reserves the right to disclose any information we have about you (including your identity) if it is determined that such disclosure is necessary in connection with an investigation or complaint regarding your use of the website, or to identify, contact, or bring legal action against someone who may be violating or interfering with Dreame's rights or property, or the rights or property of other users of the website. Dreame  explicitly reserves the right to disclose any information that is considered as necessary to comply with any applicable laws, regulations, legal processes, or governmental requests at any time. Dreame may also disclose your information if Dreame determines that applicable laws require or permit such disclosure.

5.7 For authorities, the European Commission, and the European Digital Services Authority, we maintain an electronic contact point at compliance.eu@dreame.tech,available in English and Dutch.  For user inquiries, our contact point is aftersales@dreame.tech; contact can be made without exclusively automated means if desired.  If we are not established in the EU, our legal representative under the Digital Services Act is Dreame Technology Netherlands B.V., Spicalaan 29, 2132 JG, Hoofddorp, Netherlands, email: compliance.eu@dreame.tech.

6 Age requirements

To publish user content or use interactive features, you must be at least the minimum age required by law in your country of residence. If national law requires the consent of a parent or legal guardian, you ensure that such consent has been obtained and can be provided upon request. Regardless of this, the use of interactive features without parental consent is only permitted from the age of 16, unless the law applicable in your Member State provides for a lower age limit, which may not be less than 13 years.

7 Intellectual property and property rights

7.1 All ownership and proprietary rights and all intellectual property rights relating to the website and its content (including, but not limited to, all text, graphics, music or sounds, all communications or information, domain names and all other elements belonging to the website, individually or in combination) and all copies thereof are the property of Dreame and/or its licensors. They are protected by national and international laws, copyright treaties and agreements, and other laws. The website and its content may contain certain licensed materials, in which case Dreame's licensors may protect their rights in the event of a breach of this agreement. Any reproduction or representation of these licensed materials in any manner and for any reason without the prior consent of Dreame and, where applicable, Dreame's licensors and representatives is prohibited. Except as explicitly provided in these Terms of Use, no rights are transferred to you.

7.2 If the user violates this license agreement, uses the website without the required right of use, or otherwise infringes Dreame's intellectual property rights, the right of use granted in these Terms of Use may expire with immediate effect and the user may no longer be entitled  to use the website.  

7.3 If you believe that content infringes your rights, you can report this via the designated reporting channel. A report should include the exact location of the content, a description of the alleged infringement, your contact details, and confirmation of the accuracy of your information. Dreame will review the report promptly and take appropriate action in accordance with Section 5 of these Terms of Use.

7.4 The use of automated programs, applets, bots, or similar tools to access the websites, services, and/or their content is explicitly prohibited. This applies in particular to the downloading of content, the indexing, scraping, or caching of content, as well as any text or data mining, web scraping, or similar reproductions, extractions or uses ("TDM") of content (including, but not limited to, musical compositions, lyrics, audio recordings, audiovisual recordings, artwork, images, data, etc.). Any use of such methods for purposes such as training, developing, or commercializing AI systems is also prohibited, regardless of the means used, including bots, scrapers, or other automated processes.

7.5 If you submit ideas, suggestions, or recommendations regarding products or technologies on the website, Dreame is entitled to incorporate this feedback into its own product development without owing you any license fees or otherwise incurring any obligation.

8 Data protection

Dreame processes personal data exclusively in accordance with the GDPR and other applicable data protection regulations. Details, including the purposes, legal bases, recipients, storage periods, your rights, and contact points, can be found in the privacy policy available on the website. The information in the cookie policy applies to the use of cookies and similar technologies.

Dreame may process technical data and information, including device, system, and application environment, and peripherals, to enable updates, security, functionality, and support services. To the extent that this information is personal, it will be processed in accordance with the privacy policy.

9 Third-party sites and external content

The website may contain links to third-party websites, services, or content. Dreame does not control none of these and takes no responsibility for them. Their use is subject to the terms and conditions and privacy policies of the respective third parties. Please consider for yourself whether and which third-party sites you wish to use. Links or mentions do not constitute an endorsement. You are solely responsible for considering whether and which third-party offers you wish to use. Dreame accepts no liability for any damage that may arise from their use.

10 Availability, warranty, and liability

10.1 Dreame provides the websites with reasonable care and exercises reasonable care, including with regard to third-party services provided and/or made available on them. Dreame makes no further representations and/or promises beyond the statutory rights and, in particular, does not guarantee that the use of the website will be uninterrupted and/or error-free and free from loss, corruption, attacks, viruses, interference, hacking, or other security-related disruptions. Dreame makes no representations that the website or the content, services, or functions of the website will be error-free or uninterrupted, or that such errors or interruptions will be corrected, or that the use of the website will produce specific results for you. The websites are therefore provided "as is" and "as available." All information is subject to change at any time. You have no right to specific information or functions of the websites.

10.2 Dreame does not guarantee that the website will meet your requirements or that it’s use will be uninterrupted, timely, secure, or error-free. Dreame does not guarantee the results that may be obtained from using this website or the accuracy or reliability of the information available through this website. No advice or information, whether oral or written, obtained by you through this website or from Dreame may create any guarantee.

10.3 Dreame cannot guarantee that the data, files, or other information on the website that you can access, in particular download, is free of viruses, defects, or destructive functions. Dreame accepts no liability in this regard. You bear full responsibility for the use of the website and any links associated with it.

10.4 Dreame explicitly reserves the right to regularly update the website and its content, which may also result in removal, replacement, revision, updating, or modification in any other way. You explicitly agree that, unless required by law, Dreame is not responsible for the permanent availability of content and that Dreame is not liable if content is no longer available for retrieval.

10.5 This disclaimer applies to all damages, burdens, or injuries resulting from failure, error, omission, interruption, deletion, malfunction, delay in operation or transmission, computer virus, communication line failure, theft, destruction, unauthorized access, unauthorized modification, or unauthorized use, whether due to breach of contract, tort, or negligence. Dreame may in any case be liable without limitation for intent and gross negligence, for damages resulting from injury to life, limb or health, in accordance with the provisions of product liability law and from explicitly assumed guarantees.

10.6 In some jurisdictions, the exclusion of certain warranties or the limitation or exclusion of certain damages is prohibited or - only permitted to a limited extent. Therefore, some of the above limitations and exclusions of liability may not apply to you. To the extent that Dreame cannot exclude implied warranties or limit liability under applicable law, the scope and duration of such warranties and the amount of Dreame's liability may be limited to the minimum amount permitted under applicable law. Statutory consumer rights remain unaffected.

10.7 This limitation of liability also applies to the personal liability of Dreame's employees, representatives, and organs.

10.8 To the extent permitted by law, you may indemnify Dreame against any justified claims by third parties arising from unlawful user content or from culpable breach of these Terms of Use for which you are responsible of. This includes reasonable costs of legal defense. The indemnification does not apply if you are acting as a consumer and such an obligation would be inadmissible under mandatory law.

10.9 We reserve the right to offer content created using artificial intelligence (AI) as part of the Services. This AI-generated content may include text, images, videos, music, and other media formats. Dreame assumes no liability for the accuracy, completeness, or suitability of this content.

11 Termination, suspension, and consequences of termination

11.1 You may discontinue use of the website at any time and delete your account, as long as an account deletion function is available or can be accessed via support.

11.2 Dreame may terminate or restrict access to the website or your account if you violate these Terms of Use, if required by law, or if the legitimate interests of Dreame or third parties so require. To the extent required by law, Dreame may provide justification and may open an internal complaint procedure.

11.3 Upon termination, your right of access may expire. The provisions of the sections concerning user content (Section 4), intellectual property (Section 7), data protection (Section 8), warranty and liability (Section 10), and final provisions (Section 12) may continue to apply after termination.

12 Final provisions

12.1 Unless otherwise required by the mandatory law of a Member State of the European Union or another country, these Terms of Use (and any non-contractual disputes and/or claims arising out of or in connection with them) may be governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods and the provisions of private international law.

12.2 Unless prohibited and without prejudice to any statutory rights of consumers, you confirm that all disputes, claims, and legal proceedings arising indirectly or directly from or in connection with the use of the Website, Services, and Content may be settled exclusively before the competent courts in Frankfurt am Main, Germany.

12.3 These Terms of Use, together with any additional terms and conditions that you agree to when using certain elements of the Website, constitute the entire agreement between you and Dreame with respect to the use of the Website and supersede any prior agreements in this regard.

12.4 Rights and obligations under these Terms of Use may only be transferred by you with the prior written consent of Dreame. Dreame is entitled to transfer rights and obligations to affiliated companies or to transfer them in the context of restructuring, a takeover, or a sale of business areas, provided that this does not adversely affect the legitimate interests of users.

12.5 Any waiver of rights under these Terms of Use must be in writing and may not be deemed a waiver for the future.

12.6 Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions may remain unaffected. The invalid provision may be replaced by the statutory provisions.
